1. General Provisions

​These Terms and Conditions govern the sale of products by Rocca Fun Factory srl – Balloons Specialist ("the Seller"), based in Italy, to customers located in the United Kingdom ("the Buyer"). By placing an order, the Buyer agrees to be bound by these terms.

​2. Pricing and Currency

·       ​All prices for UK customers are displayed in British Pounds (GBP).

·       ​Depending on the selected shipping method (DAP or DDP), prices may or may not include UK Import VAT and duties. Please refer to our Shipping Policy for details.

·       ​The Seller reserves the right to adjust prices at any time due to fluctuations in currency exchange rates or shipping costs.

​3. Order Acceptance and Contract

​A contract is formed only when the Seller sends an email confirmation of shipment. The Seller reserves the right to cancel any order due to stock unavailability or errors in pricing.

​4. International Shipping and Customs (Brexit Compliance)

·       ​Export Status: All sales to the UK are treated as exports from the European Union.

·       ​Buyer’s Responsibility (DAP): Unless "DDP Shipping" is selected, the Buyer is the "Importer of Record" and is responsible for complying with all UK import regulations and paying all local taxes, VAT, and customs duties.

·       ​Customs Delays: The Seller is not responsible for delays caused by UK Customs inspections or courier processing times.

​5. Right of Withdrawal and Returns (Consumer Rights)

·       ​Cancellation Period: In accordance with EU and UK consumer laws, private customers (B2C) have the right to cancel their order within 14 days of receiving the goods, B2B Customers. If you cancel an order whilst it has been picked and packed, prepped for collection and not dispatched- we will deduct an administration charge of £5 plus vat  or 20% of the (product value ex vat) if greater.If the order has been already shipped out it’s not possible to cancel the order.

·       ​Return Conditions: Items must be returned in their original packaging, unused, and in "as new" condition.

·       ​Return Shipping Costs: The cost of return shipping from the UK to Italy is the responsibility of the Buyer, unless the product is defective.

·       ​Refunds: Refunds will be processed within 14 days of receiving the returned goods, excluding the original shipping costs (unless DDP was selected and included in the price).

​6. Liability and Force Majeure

​The Seller shall not be liable for any failure to perform its obligations due to events beyond its reasonable control, including but not limited to: strikes, transport disruptions, or changes in international trade laws.

​7. Product Specifications (Balloons and Party Supplies)

·       ​Product images are for illustrative purposes. Small variations in color or shade may occur.

·       ​The Buyer is responsible for ensuring the safe use of party supplies (e.g., choking hazards for children).

​8. Governing Law and Jurisdiction

​These Terms and Conditions are governed by Italian Law. Any disputes arising from contracts between the Seller and the Buyer shall be subject to the exclusive jurisdiction of the Courts of Cassino (FR), Italy
